Terms & Conditions:
Our Terms and Conditions must be accepted prior to completion of the booking process for your rental property in Nice on the French Riviera.
1. Our Contract with Our Clients:
By ticking the box you are confirming that in consideration for us providing you with the property that you agree to our Terms and Conditions. You are also confirming that you are over 18 years, you are responsible for all persons who will stay in the accommodation with you and that you take full responsibility for you and your party’s travel insurance. You are confirming that you will not allow anymore people to sleep in the Property than you have indicated upon booking. We only allow for the number of guests at a property as indicated in the property description with the exception of children less than four years who may sleep in a travel cot. Further you are confirming that you will respect the property and will not hold parties or any other gathering without our express consent prior to booking.
2. Reservation payment:
25% of the total of any reservation is required to secure dates for an advertised property. Until the Reservation payment has been paid no reservation can be guaranteed. This payment is non-refundable. Should you be booking a property with us within 60 days of arrival, 100% of the rental amount will be due to secure the reservation.
3. Confirmation of Booking:
Upon receipt of either the Reservation payment (25%) or the Full payment (100%) you will receive a confirmation email of your booking details and receipt of your payment. You will also receive all necessary information to ensure your smooth arrival into Nice. You will also receive an insurance document to guarantee your payment money is safe and secure these company details of The Go Grp Ltd can be seen at company membership number Q4105a at The Travel Trust
4. Balance of Payment:
We will take the balance payment automatically by charging your credit card 60 days prior to your arrival.
5. Included in the Rental Rate Price:
Your rental rates includes: The rent for the property concerned; Internet access, heating, air-conditioning and utilities are included in the rental rate. Outside hours emergency assistance, as is telephone assistance to enhance the enjoyment of your holiday between the hours of 10am – 6pm. A welcome pack (includes bottle wine, juice, water and small supply of coffee and tea and toiletries)
Also included is French taxe de Sejour (city taxe) based on a nightly charge per adult.
6. Additional “on-the-ground” charge in Nice:
Additional extra services of end-of-stay cleaning, quality professionally laundered linens and towels (bath and hand towel per person) and on-the-ground in Nice emergency coverage is paid in cash at the end of your stay – these charges are as below.
Studio apartment: 80 euro.
1 bedroom apartment: 100 euro.
2 bedroom apartment: 120 euro.
7. Key Collection process on the day of your arrival:
On your arrival day you will collect keys at either airport (open from 6am – 11.30pm) 7 days per week/365 days per year or a hotel in central Nice (50 meters from central train station) open from 6am – 12 midnight (everyday) You can arrive anytime within the above hours any day of the week – no problem! If you use our contact for the private taxi service (Laurent Falk) and advise us beforehand – Laurent will meet you at airport and also give you your apartment keys.
8. Check in and Check Out Times:
On arrival our check-in time is 4pm and on departure check-out time is 11am.
Where possible we will try and be as accommodating on both your arrival and departure day. At point of booking we will ask for your precise arrival method, full details and times. We will also ask what are your desired arrival and departure times. Once we have your ideal times (other than standard times) we will ask you to email us prior to your holiday with your specific time requests (this will be subject to other arrivals and cleaning schedules) and we will advise what is possible.
As a note it normally takes approx. 1 hour from flight arrival at Nice airport to apartment.
If a very late check-out is critical for you and you want guaranteed use of the apartment you may consider booking an extra night.
9. Cancellation Policy:
Cancellation and travel insurance go hand-in-hand. Of course unfortunately unforeseen events can occur in people’s lives so we strongly recommend that you take out travel insurance that will cover you and your family for many of the circumstances that can arise. We are very happy to issue with relevant documentation/receipts to cover for payments made.
The 25% Reservation deposit is non-refundable. We will take the balance (75%) 60 days prior to your arrival date.
Thus, if you have to cancel before 60 days – please tell us urgently and we will not request the 75% balance.
Once you have paid the full amount and you have to cancel you will be refunded as follows: over 21 days before arrival, 40% will be refunded; over 14 days before arrival, 25% will be refunded. Less than 14 days before arrival there will be no refund. This policy is there to protect the owner (as the chance of re-rental is slim and hence it will be the owner that will lose due to circumstances outside his control)
We have the right to cancel a booking (at our discretion) and refund the 25% reservation deposit (if greater than 60 days prior to arrival) and our liability is limited to the amount you have paid to us. We will not be liable for any further claim.
The above is our policy, however we believe both ourselves and our owners are human beings (so I would request that once you are clear and you formally need to cancel contact us urgently and explain circumstances and we will see what options are available – but ultimately if we cannot find suitable solution – the above terms of cancellation will stand.
Thus regarding above it is much safer and better to have personal travel insurance – this can also cover you for health and safety issues during your stay.
10. Unforeseen circumstances:
Should the property becomes unavailable for reasons outside our control (such as emergency maintenance, failure of utilities or other problems) we will offer you two choices: a suitable alternative, or a full refund of the amount already paid to us.
11. Mechanical, Electric and Technical Failures:
We cannot be held liable for any unforeseen failures e.g. internet connection, satellite television, appliances, air-conditioning, lifts etc. We shall endeavour to fix or replace machines in the event of failure as quickly as possible. At our absolute discretion we will offer alternative accommodation or a refund for inconvenience caused.
Where Wi-Fi is advertised in our properties, access is free. However, as we know with technology we cannot guarantee that the internet connection will always be available. Where internet connection is not available we operate a policy of a maximum of 50 euro compensation for up to 7 days stay. We cannot be held responsible for the non-compatibility of your laptop with the modem.
12. Utility Failure:
We cannot be held liable for any unforeseen failure of electricity, water or gas. In the event of failure that we are unable to rectify a full refund will be offered to you and you will be required to vacate the property. Where possible, you will be offered an alternative property.
13. Access to Authorized Personnel:
You agree that persons authorized by us may enter the property during your stay with us to carry out necessary repairs and maintenance as appropriate. We will ensure as far as possible that you are notified of their arrival and will try as far as possible to arrange visits at a time convenient to you, to respect your privacy, and not interrupt your stay.
We Go-Nice/The Go Grp Ltd are not liable for losses incurred through circumstances outside of our control. This includes but is not limited to accident or injury to any member of your party or visitors, loss or damage to any personal goods or property, travel delays, burglary, theft, nearby building works, noisy neighbors, the closure of swimming pools, breakdown of lifts, bad weather conditions, transportation strikes, volcanoes and anything that causes a loss of enjoyment of the property.
We accept bookings from our guests who are choosing to live like locals. Locals sometimes have to tolerate any noise or nuisance from building works, neighboring apartments or utility temporary shutdowns. You agree prior to booking that you wish to live as a local.
For circumstances within our control, our responsibility (and that of our Owners) is limited to the amount of rent paid to us.
We accept no liability for personal injury, claims or damages for your misuse of any safety systems available on the property or negligence of use of stairs, balconies, terraces and wet floors or any other everyday household hazards.
15. Website Details:
It is your responsibility to satisfy yourself that the style, type, standard and location of the accommodation chosen suit your purpose. All necessary information to do this is on the website and we are here to answer any questions you may have prior to booking. All our properties are exclusively managed by us and any advertisements on external advertising sites lead back to our site. We cannot be responsible for discrepancies on any sites other than our own site www.Go-Nice.com
16. Pets and Smoking:
We do not allow Pets or smoking inside apartments.
The person providing their contact details at the time of booking shall be liable for the good behavior of all guests in the party. Failure to behave in a proper manner with respect for neighbors and property will be construed as a breach of our terms and conditions. Should complaints be received from neighbors or should we be informed of any damage to the property (caused by you or your party) you will be asked to leave the premises. Should you fail to leave we will take further action.
18. Breach of Terms and Conditions:
In the event that you breach our Terms and Conditions, your agreement with us is terminated. We will ask you to leave the property immediately. We will not be liable for any associated costs of further claims.
19. Our Advertised Properties:
All our properties have been personally chosen by us and every effort is made to adhere to our high standards we set.
20. Governing Law and company details:
The governing law is English Law.
